Terms and Conditions

Introduction

These terms and conditions outline the agreement between you, the Client, and Simoné Massyn Photography & Design (“the Photographer/Service Provider”). By booking any of my services, including photography, graphic design, social media management, or website development, you agree to the following terms and conditions.


General Terms

Booking and Payment

  1. Booking Confirmation

    • Bookings are confirmed upon receipt of a 50% non-refundable deposit.
    • The remaining balance is due on or before the date of service (for photography) or before delivery of final products (for design or marketing services).
  2. Payment Methods

    • Payments can be made via EFT or cash.
  3. Rescheduling

    • Rescheduling requests must be made at least 7 days prior to the session/event.
    • Rescheduling is subject to availability.
  4. Cancellations

    • Cancellations made by the Client will result in the forfeiture of the deposit.
    • If the Photographer/Service Provider must cancel due to unforeseen circumstances, a full refund of any payment will be provided.

Travel and Additional Costs

  1. Travel Fees

    • Services within Port Elizabeth are included in the quoted price.
    • Services outside Port Elizabeth will incur additional transport fees, which will be quoted beforehand.
  2. Accommodation Costs

    • For services requiring extensive travel (e.g., destination weddings), accommodation costs will be the responsibility of the Client.
  3. Permits and Location Fees

    • Any location requiring permits or additional fees is the responsibility of the Client.

Photography Services

Client Responsibilities

  1. Punctuality

    • Arriving late to a session will result in a reduced shooting time. The Photographer is not obligated to extend the session beyond the agreed time due to other commitments.
  2. Preparedness

    • The Client is responsible for ensuring that all participants are dressed and ready at the scheduled time.
  3. Weather Conditions

    • In cases of unsuitable weather, the Photographer will reschedule the session at no additional cost.

Image Editing and Delivery

  1. Sneak Peeks

    • Clients will receive sneak peeks within 2 weeks after the session.
  2. Final Delivery

    • Standard sessions: Final edited images will be delivered within 4 weeks.
    • Weddings: Final edited images will be delivered within 8-10 weeks.
  3. Editing Scope

    • The Photographer provides color correction, lighting adjustments, and basic retouching. Extensive edits (e.g., body modifications) may incur additional costs.
  4. File Format and Delivery

    • Images will be delivered digitally via an online gallery or email.

Copyright and Usage

  1. Photographer’s Rights

    • The Photographer retains copyright of all images.
    • Images may be used for portfolio, marketing, and promotional purposes unless the Client explicitly requests otherwise in writing.
  2. Client Usage

    • The Client is granted a non-commercial license to print and share images for personal use.
    • Commercial use of images (e.g., marketing, advertising) is prohibited unless otherwise agreed upon in writing.

Graphic Design Services

Lead Times

  1. Stationery

    • Design concepts take 2-3 weeks. Changes to the design may extend this timeline.
    • Printing requires additional time as services are outsourced. Clients are encouraged to contact us at least two months in advance.
  2. Wedding Websites

    • Lead times are 3-4 weeks from receiving complete information. Rush fees apply for expedited timelines.

Design Process

  1. Revisions

    • Each design package includes up to 3 rounds of revisions. Additional revisions will incur an extra fee.
  2. Approval

    • Clients must proofread and approve all final designs via email or WhatsApp.
    • Simmas Design & Photography is not responsible for errors in approved designs. Reprints due to client oversight will incur additional costs.

Delivery and Printing

  1. Digital Delivery

    • Designs are delivered digitally via email in standard formats (e.g., PDF, JPEG).
  2. Printing

    • Printing services are outsourced and will incur additional costs.
  3. Delivery

    • Clients outside Port Elizabeth are responsible for delivery fees.
    • Simmas Design & Photography is not liable for damages caused by third-party couriers.

Social Media Management

Scope of Services

  1. Content Creation

    • Social media packages include the agreed-upon number of posts and stories per week.
    • Clients must provide any specific content or information required for posts in advance.
  2. Platform Management

    • The Photographer/Service Provider is not responsible for platform performance metrics, such as engagement or follower growth, as these depend on multiple factors beyond content.
  3. Photography Add-ons

    • Monthly photoshoots for content creation are subject to availability and must be scheduled in advance.

Website Development

Development Process

  1. Content Submission

    • Clients must provide all necessary content (text, images, etc.) before the project begins.
  2. Revisions

    • Each website package includes 1 round of revisions. Additional revisions will incur a fee.

Hosting and Domains

  1. Domain Registration

    • Domain registration is the responsibility of the Client unless otherwise agreed.
  2. Hosting Fees

    • Hosting fees are not included in the package price and must be paid by the Client to their hosting provider.

Additional Terms

  1. Respect and Kindness

    • Simmas Design & Photography operates on a foundation of mutual respect and kindness. Disrespectful behavior will not be tolerated.
  2. Liability

    • The Service Provider is not responsible for delays or damages caused by circumstances outside its control, including but not limited to late client submissions, third-party printing issues, or courier mishandling.
  3. Force Majeure

    • Circumstances beyond the Provider’s control (e.g., natural disasters, illness, equipment failure) may result in rescheduling or cancellation, with refunds provided as necessary.
  4. Confidentiality

    • All personal information provided by the Client will remain confidential and will not be shared without consent.
  5. Creative Authority

    • Simmas Design & Photography reserves the right to have the final say in all creative aspects of design, photography, and associated services.
  6. Portfolio and Marketing Use

    • The Service Provider retains the right to use works for marketing and portfolio purposes unless otherwise agreed upon in writing.
  7. Agreement and Modifications

    • By booking services, the Client agrees to these terms and conditions.
    • The Photographer/Service Provider reserves the right to modify these terms without prior notice.
